Installation of an Interlock Device After a DWI
The installation of an ignition interlock device is mandatory for all defendants convicted of a first drunk driving offense with a Blood Alcohol Concentration (BAC) of 0.15% or higher or for a DWI conviction for a subsequent offense. The requirements for installing an Ignition Interlock Device are as follows:
- 1st DWI offense BAC of 0.15% or greater- defendant will be required to install the interlock device in their vehicle for 6 months to 1 year (set by the court once after license restoration).
- 2nd DWI offense- installation of an ignition interlock device is mandatory, regardless of the BAC, for a period of 1 to 3 years following restoration.
- 3rd and subsequent DWI offense- mandatory installation of the ignition interlock device for 1 to 3 years (longer periods imposed at the discretion of the judge) following license restoration.
The interlock device acts as a Breathalyzer that is electronically attached to the vehicle’s engine. An individual must blow into in order to start and continue driving the car. If your BAC is more than 0.05% (or above whatever level is mandated by the Court), the car will not start.
Penalties for Failure to Install an Interlock Device
There are serious consequences for failing to comply with the Court’s order regarding interlock devices. If you fail to install the device, you will lose your driving privileges for an additional year. If you are found guilty of driving a car without an interlock device, damaging or altering the device, or using another person’s breath sample, you face up to 6 months in jail and an additional 1-year loss of license.
